Harnett County, North Carolina Arrest Records

Harnett County, North Carolina, consists of a county government along with multiple municipal administrations. Each level of government may operate its own policing force. For example, the county government has the Harnett County Sheriff's Office, and the two largest municipalities operate the Dunn Police Department and the Angier Police Department

When these agencies take someone into custody, they create a record of the arrest that documents basic information like the person's name and alleged charges. These records are known locally as Harnett County arrest records.

Members of the public who wish to see these records rely on the North Carolina Public Records Act, codified at N.C. Gen. Stat. §§ 132-1 et seq., for legal backing. The Act designates arrest data as a public record and only limits access to information that another law specifically restricts.

A related type of record is criminal history record information (CHRI), which is governed by N.C. Gen. Stat. § 143B-902-905 and related provisions. Compared to basic arrest records, CHRI access is generally limited to the subject of the record and authorized agencies.

Are Arrest Records Public Information in Harnett, North Carolina?

Yes. Harnett County arrest records are readily available to the public under the North Carolina Public Records Act. N.C. Gen. Stat. § 132-1.4(c) specifically mentions that the time, date, location, nature, and other particulars of a crime shall be public records.

Anyone can request an arrest record in person or by any other official channel provided by the agency that holds the desired information. Under N.C. Gen. Stat. Under § 132-6(b), the public can obtain records without informing the record custodian of their purpose or motive for requesting the documents.

What Do Public Harnett County Arrest Records Contain?

Pursuant to N.C. Gen Stat. § 132-1.4(c), public Harnett County arrest records may contain the following:

  • Date, time, and location of an arrest
  • Nature of the alleged crime or violation
  • Name, sex, age, address, and employment of the arrestee
  • Alleged offense(s)
  • Circumstances surrounding the arrest

These are known as front-page records, as state law historically considered information appearing on the front page of a police incident or arrest record as public.

Conversely, N.C. Gen. Stat § 132-1.4(a)-(b) stipulates that "records of criminal investigations" and "criminal intelligence information" are confidential. This and other confidentiality provisions restrict public access to data that may jeopardize an investigation, information protected by privacy laws, and material expunged by court order. These include

  • Juvenile arrest records
  • An arrestee's mental health or medical records
  • Police investigative files
  • Confidential informant, victim, and witness information
  • Unique personal identifiers (such as social security, bank account, and driver's license numbers)

Harnett County, North Carolina Arrest Search

Record seekers may turn to state and federal resources to locate arrest records related to a Harnett County resident. State arrest search options generally come in two forms. The first is a service that allows users to request someone's criminal background history information, which includes arrests. The second is the judiciary's case search tool, which typically features criminal case dockets that may include arrest-related information.

Regarding North Carolina's criminal history record information (CHRI), the NC State Bureau of Investigation offers fingerprint-based personal CHRI checks. Known as a Right to Review, the agency charges $14 per check. This service is only available for personal use; the SBI does not accept third-party requests. A Right to Review record often includes arrest dates, arresting agency, charges filed, and conviction information. However, qualified agencies or organizations may request someone's CHRI for employment or related purposes through a separate process

Individuals may search for others' criminal records through the North Carolina Judicial Branch's statewide case search. Users can type a name and apply the appropriate filters to review criminal case dockets from Harnett County. A standard criminal docket includes the offense date, the arresting agency, and the charges filed, along with the basic case summary.

Finally, interested persons may request a copy of their own Identity History Summary from the FBI. This is a national arrest and criminal history report sourced from federal and state departments throughout the country.

Harnett County Inmate Locator

Members of the public may locate individuals housed at the Harnett County Jail through the Sheriff's Office Inmate Population Search portal. The default inmate roster displays people currently confined in the jail facility. While it does not have a traditional name or booking number search functionality, users can order the roster in several ways:

  • Charges: Typing a specific charge (e.g., DUI) displays everyone in the county jail arrested or convicted of the searched offense
  • Arresting Agency: Selecting "Dunn" from the options field, for example, brings up records of people arrested by that specific agency.
  • Date Range: Users can create a custom range or select a preset to view records of people booked during a specified time interval.

Information viewable through this inmate database includes the inmate's demographics, booking details, total bond, and chronology of charges. Further inquiries can be made in person, by mail, or by phone at

Active Warrant Search in Harnett County

A warrant is a judicial order authorizing law enforcement to take someone into custody. It is issued by a local judicial officer after reviewing a police application or sworn affidavit and weighing the evidence for probable cause. An active warrant typically includes the name of the person to be arrested, the alleged offense, the issuing court, and the judge's signature.

Most warrants in Harnett County are issued by magistrates, although judges of the District and Superior Court have the same powers. Any local police department may request a warrant, and the Sheriff's Office may execute any active criminal or bench warrant. The agency maintains a Wanted Persons roster listing the person's name, warrant number, and the reason for the warrant issuance. Record seekers may also contact the Warrants Division by phone at (910) 893-0121

According to N.C. Gen. Stat. § 132-1.4(k), arrest and search warrants that have been executed and returned to the court are public records and may be withheld only when sealed by court order. By implication, unserved or outstanding warrants may stay restricted until executed. Law enforcement may also choose to make them publicly available, such as through a "Wanted Persons" notice.

How to Find Arrest Records for Free in Harnett County

There are two primary options for locating arrest records for free in Harnett County:

  • The Sheriff's free inmate lookup tool allows record seekers to pull up inmate profiles of individuals arrested and booked into the county jail. Users can access basic arrest information at no cost.

However, this resource may not include the records of non-booked individuals (i.e., people arrested and then released without charge or on bond and not processed into the county jail). The inmate roster also displays a person's history of past arrests and bookings, but it may not list every individual who has completed their sentence and left the county jail.

  • Record seekers can freely query the statewide judiciary case portal and review criminal dockets, which contain the formal charges tied to an arrest, along with basic arrest information. For optimal usage, users may need to provide a first and last name, an arrest date range, or a case number.

It is important to note that these free tools do not display material redacted by statute or a court order, such as juvenile records, core investigative materials, or sensitive personal information.

Harnett County Arrest Report

An arrest report is a law enforcement officer's extensive account of what happened at the scene of an arrest. While some of the content overlaps with the facts outlined in a basic arrest record, a report seeks to contextualize those facts rather than simply state them. The goal is to evaluate and understand the circumstances of the incident.

Beyond basic arrest details, a Harnett County arrest report may also include

  • Arresting officer's name, badge, and unit
  • The officer's account of what happened
  • Personal observations leading to, during, and after the arrest
  • Evidence or arguments supporting why the arrest had to happen
  • Witness or victim statements
  • Evidence collected

Pursuant to N.C. Gen Stat. § 132-1.4, arrest reports featuring investigative material are exempt from public disclosure.

How to Get an Arrest Record Expunged in Harnett County

Pursuant to N.C. Gen. Stat. § 15A-145 et seq., eligible individuals may be able to clear their Harnett County arrest records through a process known as "expunction." An expunction permanently clears the arrest and charge records from public government databases, including local police portals and state background check repositories.

Note the following eligibility standards:

  • Non-conviction cases (acquittals, dismissals, and "not guilty" verdicts) qualify for immediate expunction under N.C. Gen. Stat. § 15A-146. Cases disposed of after December 1, 2021, are automatically expunged.
  • A single non-violent misdemeanor conviction can be expunged three years after case disposition, while multiple convictions of the same category can be expunged 7 years after the latest case disposition (N.C. Gen. Stat. § 15A-145.5(b)(1)
  • The waiting period to expunge non-violent felony convictions pursuant to N.C. Gen. Stat. § 15A-145.5(b)(2) range from 10 years for a single felony to 20 years for two or three felonies.

Individuals who qualify for expunction can file an Administrative Office of the Court (AOC) petition form at the Harnett County Clerk of Superior Court. Expunging a non-conviction record is generally free, while petitioning to expunge a conviction record typically costs $175 per petition.

How Do You Remove Harnett County Arrest Records From the Internet?

Individuals who have secured an expunction order from a judge may find that their arrest records no longer appear on official government databases. However, the same records may remain visible on third-party background check websites.

An expunction order generally applies only to government-maintained records and does not cover private websites. Hence, these websites are under no obligation to delete any specific record, although some may do just that when their official sources are updated.

For the rest, the individual may use the particular website's opt-out mechanism to contact the site administrator or submit a written request for record removal along with the order of expunction.
